By using the Check WellCare platform (“Service”), you acknowledge and agree to the following terms and
limitations. Please read carefully before proceeding.
1. Not a Medical Service
Check WellCare is a wellness check and reminder platform. It is not a medical service,
hospital, or emergency provider. The Service does not diagnose, treat, cure, or prevent any medical condition,
nor should it be considered a substitute for medical advice from a licensed healthcare professional.
Always consult your physician or qualified health provider with any questions you may have regarding a medical
condition. If you believe you or your loved one is experiencing a medical emergency, call 911
immediately.
2. Emergency Limitations & "No 911" Policy
Check WellCare is not an emergency response service. We employ a limited "retry logic" (calling
up to 3 times) before sending an alert to a caregiver. We do NOT call 911 or dispatch emergency care
providers.
The platform cannot guarantee timely detection of emergencies, missed calls, or sudden health events. Taking
action on an alert is the sole responsibility of the caregiver. You agree not to rely on this Service as your
sole means of emergency monitoring.
3. Accuracy & AI Data Limitations
The Service relies on user-provided information, scheduled calls, and system functionality. Wellness scores and
mood distributions are generated by AI based on vocal sentiment and self-reported answers. These scores are
informational only and should not be used as the sole basis for medical intervention.
While we make reasonable efforts to ensure reliability, we cannot guarantee the accuracy, completeness,
or timeliness of data collected. Missed calls, device errors, connectivity issues, or carrier delays
(including "Do Not Disturb" settings) may affect functionality.
4. No Liability for Outcomes
By using this Service, you understand and agree that Check WellCare, its affiliates, employees, and contractors
are not responsible or liable for:
- Any injury, illness, harm, or death arising from reliance on the Service.
- Missed calls, alerts, reminders, or failures in monitoring.
- Technical errors, outages, or service interruptions.
- User negligence, failure to respond, or incorrect data entry.
Use of this Service is entirely at your own risk.
5. Privacy & Data Use
We respect your privacy. By using the Service, you consent to the collection and storage of your information
(including name, contact details, wellness data, and call logs) for the purpose of providing care reminders and
monitoring.
Your information is handled with HIPAA-compliant architecture. We do not sell your personal information
to third parties. We generate revenue through subscriptions, not your data. For more details, please

6. Consent to Contact & AI Transparency
By registering, you consent to receive automated calls, reminders, and communications from Check WellCare,
including from our AI assistant "Ava". You acknowledge that check-in calls are conducted by
Artificial Intelligence, not a human. Caregivers confirm they have obtained explicit consent
from the senior to receive these calls and share wellness data.
7. User & Caregiver Responsibilities
You agree that you or your designated caregiver remain solely responsible for:
- Responding to calls, alerts, and reminders.
- Maintaining updated contact information in the Service.
- Taking appropriate actions based on reported wellness data.
- Ensuring the recipient's phone can receive calls (e.g., checking "Safe Callers" lists).
8. Acceptance of Terms
By checking the box below and continuing with registration, you acknowledge that you have read, understood, and
agreed to this Disclaimer and Consent. You understand the limitations of the Service and accept full
responsibility for its use.
